It’s launch party in 2008/9 had more glitz and glamour than your average West End film preview, with Premiership footballers, rugby world cup winners and the crème de la crème of Marbella’s glittering social scene in attendance, but since its opening in June, Buddha Beach has quickly gained a reputation as a relaxed setting for both residents and visitors alike, keen to experience Marbella’s first boutique beach club.

Located in the quiet residential development of Villa Marina, just across from the Hotel Andalucia Plaza, Buddha Beach is the creation of Clare Strutton and her partner Ian Radford. Clare is a huge fan of Thailand and has spent months at a time there, and when Ian visited he too was hooked on the relaxed and peaceful style of life. When the opportunity to buy the old Moosh Moosh Beach presented it, Clare decided to recreate a little of the peace and serenity of Thailand in Marbella.

The setting itself is stunning, with a pool area with raised sundecks, two tropical bars perfect for sundowners, a separate beach with waiter service, spa, boutique and VIP area with its own 12-seater rockpool Jacuzzi. As the name suggests Buddhas and other Far Eastern items are very much in evidence in the décor. The focal point for my visit, however, was the restaurant.

The first thing that I must mention about Buddha Beach is the staff. They are to a man, and more importantly in my case, woman, “aesthetically pleasing to the eye”. In fact a couple of them were described by my dining companion as being “really buff”. Model looks aside, however, they are all extremely pleasant (a rare trait in models, let me assure you) and we were soon seated in the busy restaurant, where I spotted a couple of well known locals, all obviously enjoying their al fresco lunch, accompanied by the subtle tunes of the live DJ.

For starters I plumped for the gazpacho, perfect for a hot day on the beach, while my companion went for the salt and pepper squid with chilli and garlic mayonnaise, which she thought was wonderful. My main course was the Thai Green curry with prawns, which was beautifully presented in wooden bowls, and I noticed a popular dish with other dinners. My guest had a Caesar salad, and pronounced it the best she’s tasted since New York (She lives in Martha’s vineyard and I hadn’t her in 20 years)

We washed this down with a jug of sangria (it was, as I said a hot day on the beach and we hadn’t seen each other in 20 years) though there is an extensive wine list.

Another table was really pushing the boat out and had plumped for the Marbella Platter, which consists of – and take a deep breath here – a whole lobster and whole crab, four king prawns, baby prawns, four oysters and dipping sauces while on another table a couple were tucking into the Chateau Briand served with Béarnaise, onion rings, mushrooms and tomatoes. Both were spectacularly presented.

If course, if you’re thinking of hitting the pool after your meal and don’t want to sink like a stone, the sushi platter or moules frites may be a better option, and there’s a “Snack and Wrap Menu” that you can enjoy on your sunbed without interrupting the serious business of sunbathing.

Buddha Beach has a selection of regular events, such as the Sunday Sunset Sessions, which offers a BBQ from 5pm for a very reasonable €20, and the venue should prove popular for private parties and special events. Well-behaved children are also welcome, and the main cocktail bar features two discreet TVs so that you can enjoy sporting events. “We’ve created the type of place that we wanted to come to,” explained Clare as we left. I disagreed. Buddha Beach is the type of place everyone wants to come to.

Revived! Robert Trent Jones Sr’s Latest Course

Marbella Golf & Country Club announces the opening of its newly enhanced 18 hole course in October 2009. Working with a small team schooled in the design expertise of Robert Trent Jones Snr (Marbella Golf’s famed original designer), the club has re-routed the course around a small parcel of land that reverted to its owner in the spring, built four new greens replete with new tees, fairways and bunkers - all in the style of the most celebrated golf designer born in the 20th century.

Designed by the legendary Robert Trent Jones Senior, and located just 5 minutes drive from the cosmopolitan town of Marbella, Marbella Golf & Country Club provides one of the best and most challenging golfing experiences in the whole of Europe. Occupying one of the largest remaining green areas on the Costa del Sol, the 6.000 meter long 18-hole links course with a par of 72 has been imaginatively designed to respect the natural terrain. The facilities the Club House offers are a magnificent restaurant, conference rooms, a Pro-shop, a driving range and putting green, tennis courts and a Wellness Centre offering yoga and Pilates classes and a variety of massage and physiotherapeutic treatments.

“Trent Jones Snr wrote extensively about his design style, and some members of our team worked closely with him on the original design of our course”, says Marbella Golf’s director, Christina Cortese.

“Armed with this information and experience, as students of golf design, they researched Jones’s legacy meticulously, answering the question: what would he have done, if we had re-commissioned him today? As Mr Jones is no longer able to come to us, we went to him: his courses speak for themselves, as does his book ‘Golf’s Magnificent Challenge’, in which he clearly tells us what to do. In our quest for authenticity, our team inspected courses both nearby here in Spain, and as far away as California.”

“The result: a new opportunity for 21st century players to pit their game against the master designer of the 20th century. So, not only will golfers find that every hole meets Jones’s famous maxim: ‘Difficult par… easy bogey’, but that his other dictats have also been keenly observed - in particular ‘making golf holes is more art than science’.

There will also be an element of ‘audience participation’: Trent Jones Snr advised clubs not to install all the bunkers on a new course until it had been in play for a while: that way, their correct positions would find themselves. Craig Cooke, Marbella Golf’s Golf Course Superintendent and project leader, says: “I remember working for Mr Jones on this very course: I’ll feel him watching me all winter, as we are shown where to mark the new traps out…” Cabell Robinson, who played a leading role in the design of the original course, and has been a helpful observer during recent months, remarks: “It’s been like going back in time to rebase ourselves in 1989 (when the course was originally built), yet going forward in time to adjust for the tremendous changes to the game since – new local Health & Safety requirements, included. Here, once again, the authentic voice of Mr Jones will echo up rustic fairways...”

David Steele, Director of Golf, comments: “Trent Jones Snr may have had it in for tour players, like myself: he set out to challenge us, by his own admission. So much so that Ben Hogan said he would have won more Majors, if only they had been played on Jones’s courses: they were so tough that only the best players would rise to the challenge – off the back tees. But Jones’s greatest asset was that he designed courses for all standards of golfer. He himself said: ‘The prime consideration is that everybody, at all levels, can play and enjoy… day after day and year after year.’ This is what we are re-creating here – and, yes, it will be tough off the back!”

Jones’s own words add a prophetic twist to this highly creative project: ‘I have some qualms about changing the work of great architects who are dead and unable to defend themselves.’ It is a great credit to the master himself that the club have changed only the minimum of his original design. This enhancement is indeed as much a restoration of original styling, as a remodelling.

Moreover, from October, golfers can help the club with the project themselves, by playing the new course and thus identify all those new bunker locations: for sure, to use Jones Snr’s own words, it will be ‘a course that everybody, at all levels, can enjoy…’.

La Opinion de Malaga article: Collective Dismissals by CCG

APPEALING TO THE GOVERNMENT

A right that can not be waived

David and Goliath, citizen and government. This is the image that comes to mind when we receive penalty notices, fines from the tax office, social security notifications saying they’re freezing our bank accounts and other communications that we often receive from local, regional or national authorities.

Fortunately there are instruments that allow us to contest such notifications. Spanish legal system provides with ways to challenge, contest and appeal against every type of notification that we believe is infringing on our rights. Article 24 of the Spanish Constitution grants one of the most important fundamental rights: the right to judicial protection from Judges and Courts. We can only gain access to this right is by appealing.

Firstly, and without forgetting our obligations as citizens, we have to check whether the offense we have been charged with is true or not, if there is any proof either way, the reasons for the charge, its legal groundings and what the government states in the notification about appealing against the charge.

Do not miss out on the chance of receiving mailed notifications, because the Government also has other methods of giving out notifications, i.e. publishing them in the Official State Gazette (Boletín Oficial del Estado - BOE) etc. We cannot say “I did not receive this”. In fact notifications open up the best way of challenging the resolutions that we receive from the Government. It allows us to keep intact all the rights that we can execute.

If facts are not accurate, there is no proof, charges do not accommodate our rights, the fine that they attempt to impose on you is ridiculous or you are not being informed of your right to appeal, then we should do something. We should not remain passive, leaving the matter unsettled and allowing the formidable government authority to leave us defenceless and eventually freeze our bank accounts. The Government itself offers us guides on how to appeal, for example, the tax office even allows you to appeal through the internet if you have available the electronic certificate X.509.V3 issued by a certifying authority recognised by the AEAT http://www.aeat.es/

Most often you'd have to appeal before Town Hall, Social Security branch http://www.seg-social.es/, province branch of Traffic Department or the local Tax Office. It is also often the case that they will dismiss your request. However, it is an essential step to be able to legally appeal later on if necessary.

Statistics show that those who appeal against unjust resolutions or disproportionate penalties often do receive the support of judges at court cases.
